These Terms and Conditions (“Terms”) apply to your access to and use of the Desert Vibes website, mobile experience, digital services, content, booking tools, social features, and any related platform operated by Desert Vibes (“Desert Vibes”, “we”, “us”, or “our”).

By using the Desert Vibes Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform.

You must be at least 18 years old to use the Platform, create an account, make a booking, submit content, or use any Desert Vibes services. If you use the Platform on behalf of a minor, you confirm that you are legally authorized to do so and accept responsibility for that minor’s use.

If you create an account, you must provide accurate and complete information. You are responsible for keeping your login details confidential and for all activity under your account.

We may suspend or terminate your account if we believe that you have breached these Terms, provided false information, misused the Platform, or acted unlawfully.

8. Use of Platform Content

All text, images, videos, graphics, logos, trademarks, designs, itineraries, guides, maps, software, and other content on the Platform are owned by Desert Vibes, licensed to us, or used with permission.

Desert Vibes may provide information about destinations, activities, attractions, events, weather, safety, travel guidance, cultural recommendations, and third-party experiences.

This information is provided for general guidance only. You are responsible for checking official requirements, local laws, safety conditions, visa rules, health guidance, event schedules, operator terms, and travel restrictions before making plans.

10. Bookings and Third-Party Services

Where the Platform allows you to book or access tours, activities, events, transportation, accommodation, restaurants, or other services, those services may be provided by third-party operators.

Desert Vibes is not responsible for third-party performance, availability, pricing, cancellations, delays, safety standards, or service quality unless expressly stated otherwise. Your booking may be subject to the relevant provider’s own terms and conditions.

11. Payments, Cancellations, and Refunds

Prices, availability, taxes, fees, cancellation windows, refund eligibility, and booking conditions may vary by service or provider.

You agree to review all booking details before confirming a purchase. Refunds and cancellations will be handled according to the applicable booking terms shown at the time of purchase or provided by the relevant service provider.

12. User-Generated Content

If you upload, submit, tag, post, review, or share content with Desert Vibes, including photos, videos, comments, reviews, or feedback, you confirm that:

  • You own the content or have permission to share it.
  • The content is accurate where it states facts.
  • The content does not violate any law or third-party rights.
  • The content is not offensive, defamatory, misleading, abusive, or harmful.

By submitting content, you grant Desert Vibes a worldwide, royalty-free, non-exclusive license to use, reproduce, edit, publish, display, translate, distribute, and promote that content in connection with the Platform, marketing, and related services.

13. Prohibited Use

You must not misuse the Platform. This includes:

  • Using the Platform for unlawful, fraudulent, or harmful purposes.
  • Introducing viruses, malware, bots, scraping tools, or harmful code.
  • Attempting to gain unauthorized access to systems, accounts, servers, or data.
  • Interfering with Platform security, availability, or functionality.
  • Posting misleading, offensive, infringing, or unlawful content.
  • Using Desert Vibes branding without permission.

The Platform may contain links to third-party websites, apps, services, or resources. These links are provided for convenience only. Desert Vibes does not control and is not responsible for third-party content, policies, availability, or services.

15. Linking to Desert Vibes

You may link to publicly available pages on the Platform in a fair and lawful way, provided that the link does not damage our reputation, suggest false endorsement, or misrepresent your relationship with Desert Vibes.

We may request that you remove any link to the Platform at any time.

16. Disclaimer

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Desert Vibes does not guarantee that the Platform or its content will be accurate, complete, current, secure, uninterrupted, or free from errors or viruses.

17. Limitation of Liability

To the fullest extent permitted by law, Desert Vibes will not be liable for any indirect, incidental, special, consequential, punitive, or economic loss arising from your use of the Platform, reliance on Platform content, third-party services, travel decisions, booking issues, or inability to access the Platform.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

18. Indemnity

You agree to indemnify and hold harmless Desert Vibes, its owners, employees, partners, contractors, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising from your breach of these Terms, misuse of the Platform, violation of law, infringement of third-party rights, or submitted content.

19. Suspension or Termination

We may suspend, restrict, or terminate your access to the Platform if we reasonably believe that you have breached these Terms, misused the Platform, created risk for Desert Vibes or other users, or violated applicable law.

20. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia.

Any dispute arising out of or relating to these Terms, the Platform, or Desert Vibes services will be subject to the exclusive jurisdiction of the courts of Saudi Arabia, unless applicable law requires otherwise.
